Welcome to Connect66 (“Connect66,” “we,” “us,” or “our”). These Terms of Service (“Terms”) and our Privacy Policy (together, the “Agreement”) govern your access to and use of our websites, apps, dashboards, data layers, APIs, SDKs, embeds, exports, and related services (collectively, the “Services”). By creating an account, clicking “I agree,” or using the Services, you accept these Terms.
If you do not agree, do not use the Services.

1) Eligibility & Authority

• Minimum Age: You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction if higher (e.g., up to 16 in certain regions).

• Minors: If you are under the age of majority where you live, you may use the Services only under the supervision of a parent or legal guardian who accepts these Terms on your behalf.

• Organizations: If you use the Services on behalf of an organization, you represent you have authority to bind that organization. “You” includes that organization.

2) Accounts & Administrators
You are responsible for safeguarding your credentials and all activity under your account. Organization administrators (“Admins”) control seats, roles, billing, and retention settings. Notices to Admins are deemed notices to the organization.

3) Acceptable Use & Moderation

You agree not to, and not to allow others to:

• Violate law; probe or test security; bypass access controls, rate limits, or quotas.
• Copy, scrape, harvest, or export content/data at scale without written permission.
• Upload or share unlawful, infringing, deceptive, harassing, exploitative, or harmful content, or others’ personal/sensitive data without consent.
• Introduce malware, attempt account enumeration, or generate fraudulent traffic.
• Use Service content/outputs to build, improve, or train models or competing services without our written consent.

Moderation: We may suspend, remove, or restrict content or accounts that violate these Terms, applicable law, or pose risk to the Services or users. Where legally required, we will notify you of the reason and provide a way to appeal.

4) Your Content & Feedback

• Ownership: You retain ownership of content you submit (“User Content”).
• License to Connect66: You grant Connect66 a worldwide, transferable, sublicensable, royalty free license to use, reproduce, adapt, analyze, create derivative works from, distribute, and publicly display your User Content as necessary to provide, secure, improve, and promote the Services. This license survives termination only to the extent your content remains integrated into the Services or is necessary for legal, compliance, or archival obligations. Nothing here requires you to waive rights that cannot legally be waived (e.g., certain moral rights).
• Feedback: If you provide ideas or suggestions, we may use them without restriction or compensation.
• Takedowns: We may remove or disable content we believe violates these Terms or law (see our DMCA Policy).

5) Intellectual Property & Outputs
The Services and associated IP (software, designs, data sets we provide, trademarks) are owned by Connect66 or its licensors and protected by law. Except for rights expressly granted, all rights are reserved.
• Outputs: Outputs are licensed, not sold, and remain subject to these Terms. You may not resell, redistribute, or sublicense outputs except as expressly permitted. You agree not to remove or obscure notices or identifiers we may embed in outputs to monitor compliance.

6) APIs, SDKs, & Exports
Use of APIs/SDKs is subject to these Terms and the Developer Terms Addendum.
• Do not cache or store personal data obtained via APIs/SDKs longer than 30 days, unless you (a) have a lawful basis under applicable law, and (b) disclose the retention period to your end users.
• Do not re identify or combine de identified data in a way that creates personal data.
• We may issue/revoke keys, set quotas, require attribution, audit for compliance, and modify or discontinue APIs/SDKs.

7) Third Party Services
The Services may interoperate with third party tools or content. Those providers’ terms and privacy practices apply; Connect66 is not responsible for their performance.

8) Plans, Billing, & Taxes
Some features require payment. Prices, tiers, and limits are disclosed at purchase. Subscriptions autorenew unless canceled before renewal.

Refund & Cancellation Policy: Subscriptions may be canceled at any time by the subscriber. If canceled within the first 30 days of purchase, a full refund will be issued upon request. After 30 days, subscriptions remain active until the end of the current billing cycle, and no further charges will apply. Duplicate or mistaken charges will be refunded promptly.

9) Termination & Data Retention

• You may stop using the Services at any time. We may suspend or terminate your account for violations or risks to the Services or users.
• Upon closure, we will delete or de identify personal data within 90 days, except where retention is required for legal, regulatory, fraud prevention, or legitimate business purposes (e.g., backups, audit logs).
• You may request deletion of certain data sooner where permitted by law—see our Privacy Policy.

10) Indemnification

You agree to indemnify and hold Connect66 harmless from claims arising out of: (i) your User Content, (ii) your unlawful use of the Services, or (iii) your violation of these Terms or third party rights. We will notify you of any claim and give you reasonable control of the defense, except where conflicts of interest exist.

11) Disclaimers & Limitation of Liability
• The Services are provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties to the maximum extent permitted by law (including merchantability, fitness for a particular purpose, non infringement, accuracy, availability, and security). Outputs may be incomplete or incorrect; do not rely on them as professional advice.
• Liability Cap: Connect66’s total liability for any claim is limited to the greater of (a) US$100 or (b) the amount you paid to Connect66 in the 12 months before the claim.
• Carve outs: Nothing here excludes or limits liability for gross negligence, willful misconduct, personal injury, or rights that cannot be excluded under applicable law.

12) Dispute Resolution & Governing Law
• Governing Law: Indiana law governs these Terms, unless local law requires otherwise.
• Arbitration (U.S. users): Except for small claims matters, disputes are resolved by binding arbitration administered by JAMS under its rules. Venue is Marion County, Indiana; hearings may be remote unless the arbitrator requires otherwise.
• Class Action/Jury Waiver: You waive any right to a jury trial or participation in a class or representative action.
• Opt Out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@connect66.net with your name, account email, and a clear statement of opt out.
• Non U.S. users: Where arbitration clauses are not enforceable, disputes will be brought in the courts competent under your local law.

13) Accessibility
We strive to make the Services accessible and are working toward WCAG 2.1 AA alignment. If you experience barriers, contact accessibility@connect66.net.

14) Miscellaneous
• Assignment: We may assign these Terms (e.g., in a merger, acquisition, financing, or asset sale). You may not assign without our consent.
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
• Severability; No Waiver: If any provision is unenforceable, the remainder remains in effect. No waiver is implied by delay or omission.
• Entire Agreement: These Terms, the Privacy Policy, and any referenced documents (e.g., Developer Terms, DPA, Commerce Policy, DMCA Policy) form the entire agreement between you and Connect66 regarding the Services.

15) Changes to These Terms
We may update these Terms to reflect changes to the Services or law. If we make material changes, we will provide notice (e.g., in product or email) and update the Effective Date above. Your continued use after the effective date constitutes acceptance. Where required by law, we will obtain your consent.
